1. Acceptance of These Terms

Welcome to Rogue Pen.

These Terms of Service ("Terms") govern your use of the Rogue Pen website, applications, services, and related features (collectively, the "Service").

By accessing or using Rogue Pen, including as a guest user, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

These Terms govern your use of the Rogue Pen service ("Rogue Pen," "we," "us," or "our"). If you have questions about these Terms, please contact us at realapertureai@gmail.com.

2. Eligibility

You must be at least 18 years old to use Rogue Pen.

By using the Service, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into this agreement.
  • You will comply with all applicable laws while using the Service.

If you do not meet these requirements, you may not use Rogue Pen.

3. Description of the Service

Rogue Pen is an AI-powered writing platform designed to assist users with creative writing, storytelling, roleplay, brainstorming, editing, worldbuilding, journals, blogs, novels, scripts, and other written works.

The Service uses artificial intelligence to generate text based on user prompts.

AI-generated responses are created automatically and may contain inaccuracies, errors, fictional information, or offensive content.

4. Guest Users and Accounts

Rogue Pen may be used without creating an account.

Some features — including saving your work across sessions and devices — require creating a free account. AI actions are metered by Writing Credits. Signed-in accounts receive a free credit allowance, and larger monthly allowances are available through the recurring subscription plans described in Section 12.

When creating an account, you agree to provide accurate information and keep your account secure.

You are responsible for all activity occurring under your account.

5. Acceptable Use

You agree not to:

  • Violate any applicable law.
  • Use Rogue Pen to facilitate criminal activity.
  • Upload malware or harmful code.
  • Attempt unauthorized access to our systems.
  • Interfere with the operation or security of the Service.
  • Impersonate another person.
  • Harass or threaten others.
  • Infringe another person's intellectual property rights.
  • Circumvent Writing Credit or usage limits.
  • Abuse or overload the Service.

We reserve the right to investigate violations and take appropriate action.

5.1 Adult content and sexual-content limits

Rogue Pen supports explicit adult fiction. Writing sexual content between adults — including the romance and erotica genres, and the dedicated adult writing mode — is a permitted use of the Service, and the account age requirement in Section 2 exists partly for that reason.

The following are prohibited without exception. They are prohibited even as fiction, even when no real person is involved, and regardless of how the work is framed, labelled, or justified as artistic:

  • Any sexual or sexualized depiction of a minor, or of a character presented as a minor. This includes a character described as under 18, a character presented with the body or characteristics of a child, and any attempt to describe such a character as older to evade this rule.
  • Content that sexualizes, solicits, or provides instruction for the sexual abuse, exploitation, or trafficking of any person.
  • Depictions of non-consensual sexual activity presented approvingly — as endorsed, deserved, rewarded, or as a model to imitate.
  • Content that sexualizes real, identifiable people without their consent.

The rule on non-consent is about endorsement, not subject matter. Serious fiction deals with sexual violence, and a narrative that portrays assault as harmful — as crime fiction, survivor stories and literary fiction routinely do — is permitted. What is prohibited is material written to present it as desirable.

We may refuse, remove, or decline to generate content under this section, and may suspend or terminate an account under Section 15 for violating it. Our AI providers and payment processor impose their own content rules, and we may be required to act on those as well.

6. Your Content

You retain ownership of all content you create using Rogue Pen.

By using the Service, you grant Rogue Pen a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and otherwise use your content solely as necessary to:

  • Operate the Service
  • Provide AI responses
  • Synchronize content across your devices
  • Maintain backups
  • Secure the platform
  • Improve the functionality and reliability of the Service

This license does not transfer ownership of your content.

We do not claim ownership of your work.

This license ends when your content has been permanently deleted from our systems, except where retention is required by law or exists within routine backup systems.

7. AI Training and Third-Party Processing

Your content is used only to provide the Service.

Rogue Pen does not train AI models on your content, and does not sell your writing to third parties.

To generate text we must transmit your prompts and the relevant parts of your manuscript to third-party AI providers. Those providers process your content under their own terms, which we do not control. We have not independently verified each provider's retention or training practices, so we do not promise that no third party ever retains or learns from content routed through them. Section 5 of our Privacy Policy names the providers and describes what we have and have not verified.

8. Responsibility for Your Content

You are solely responsible for everything you create, upload, or generate using Rogue Pen.

You represent that:

  • You own the rights to your content or have permission to use it.
  • Your content does not violate applicable laws.
  • Your content does not infringe copyrights, trademarks, or other intellectual property rights.
  • Your content does not violate another person's privacy or publicity rights.

9. AI-Generated Content

Artificial intelligence is inherently unpredictable.

Rogue Pen makes no guarantee that generated content will be:

  • Accurate
  • Complete
  • Reliable
  • Original
  • Error-free
  • Suitable for any purpose

You are responsible for reviewing, editing, and verifying all generated content before relying on or publishing it.

Rogue Pen does not provide legal, medical, financial, psychological, or other professional advice.

10. Intellectual Property

The Rogue Pen platform, software, branding, logos, design, interface, and underlying technology remain the exclusive property of Rogue Pen.

Except for your own content, no part of the Service may be copied, reverse engineered, redistributed, or exploited without written permission.

11. Copyright Complaints

If you believe material on Rogue Pen infringes your copyright, please contact us at:

Include sufficient information for us to investigate your claim.

We reserve the right to remove allegedly infringing material while investigating.

12. Writing Credits and Subscription Plans

AI actions on Rogue Pen (including chapter generation and manuscript import and analysis) consume Writing Credits. AI image generation is currently suspended and cannot be used, so it consumes no Writing Credits; Writing Credits already spent on images generated before the suspension are not affected.

12.1 Monthly subscription plans

Writing Credits are sold through recurring monthly subscription plans. The plans currently offered are:

  • Basic — $10 per month, including 1,500 Writing Credits each billing period. Unused credits expire at the end of each billing cycle and do not roll over.
  • Pro — $25 per month, including 4,000 Writing Credits each billing period. Unused credits roll over while your subscription stays active.
  • Max — $50 per month, including 9,000 Writing Credits each billing period. Unused credits roll over while your subscription stays active.

The plan price and included credit allowance that apply to you are the ones displayed on the Rogue Pen pricing page and on the checkout page at the time you subscribe. Plan prices and credit allowances may change, and any change applies to future billing periods rather than to a period you have already paid for.

12.2 Automatic renewal and billing

Subscriptions renew automatically. By subscribing, you authorize Rogue Pen to charge your payment method:

  • the plan price for your first billing period, at the time you complete checkout; and
  • the then-current plan price at the start of each subsequent monthly billing period.

These charges continue until you cancel. Payments are processed by our payment processor, Stripe; Rogue Pen does not store your card details. The end date of your current billing period is shown on your Profile page.

Your plan's Writing Credits are added to your account after each subscription payment succeeds. If a payment fails, Stripe may retry it; no new Writing Credits are added until a payment succeeds, and Writing Credits already in your account remain available to spend.

If you change plans mid-period, the difference is prorated by Stripe and shown to you before you confirm the change.

12.3 How to cancel

You may cancel at any time, yourself, from Profile → Manage billing, which opens the billing portal for your account. You can also change plans or update your payment method from there or from the pricing page.

Cancellation takes effect at the end of your current billing period. You keep subscription access through that date and you are not charged again. Cancelling does not produce a partial or prorated refund for a billing period already paid for — see Section 13.

12.4 What happens when a subscription ends

When your subscription ends, whether because you cancelled it or because it lapsed:

  • No further monthly Writing Credits are added to your account.
  • Writing Credits already in your account are not revoked, deleted, or expired by the subscription ending. They remain available to spend.
  • Your account and the work you have saved remain available to you.

While a subscription is active, unused credits are treated according to the rollover policy stated for your plan in Section 12.1. On a plan without rollover, the monthly allowance is reset at the start of each billing period and any unused allowance from the previous period is forfeited. On a plan with rollover, unused allowance carries forward for as long as the subscription stays active.

12.5 One-time credit top-ups

Active subscribers may also purchase one-time Writing Credit top-up packages. A top-up is a single charge, not a subscription: it does not renew, and it does not change your monthly plan. Top-up credits do not expire.

Your account page shows your current balance and where each part of it came from.

13. Refund Policy

Payments are non-refundable, except where required by applicable law.

Writing Credits that have already been purchased, whether spent or unspent, are not automatically refunded.

14. Service Availability

Rogue Pen is provided on an "as available" basis.

We may:

  • Modify features
  • Remove features
  • Add new functionality
  • Perform maintenance
  • Suspend the Service
  • Discontinue the Service entirely

at any time without prior notice.

We do not guarantee uninterrupted availability.

15. Suspension and Termination

We may suspend or terminate your access at our sole discretion, including for:

  • Abuse of the Service
  • Violations of these Terms
  • Illegal activity
  • Fraud
  • Security concerns
  • Conduct that may harm Rogue Pen or other users

Termination may occur without prior notice.

16. Disclaimer of Warranties

To the fullest extent permitted by law, Rogue Pen is provided "AS IS" and "AS AVAILABLE."

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

17. Limitation of Liability

To the maximum extent permitted by law, Rogue Pen shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.

Our total liability for any claim shall not exceed the amount you paid to Rogue Pen during the twelve (12) months preceding the claim.

If you have never paid Rogue Pen, our total liability shall not exceed one hundred U.S. dollars (US $100), to the extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Rogue Pen from any claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use of the Service
  • Your content
  • Your violation of these Terms
  • Your violation of applicable law
  • Your infringement of another person's rights

19. Arbitration Agreement

Please read this section carefully.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration.

You waive any right to bring claims in court or participate in a class action, except where prohibited by law.

Arbitration shall be conducted under applicable arbitration rules and governed by the laws of the State of California.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

21. Privacy

Your use of Rogue Pen is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information.

22. Changes to These Terms

We may modify these Terms at any time.

Updated versions become effective upon publication unless otherwise stated.

For significant changes, we may require users to accept the updated Terms before continuing to use the Service.

23. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rogue Pen regarding your use of the Service and supersede any prior agreements relating to the Service.
