1. Acceptance of These Terms

Welcome to Rogue Pen.

These Terms of Service ("Terms") govern your use of the Rogue Pen website, applications, services, and related features (collectively, the "Service").

By accessing or using Rogue Pen, including as a guest user, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

3. Description of the Service

Rogue Pen is an AI-powered writing platform designed to assist users with creative writing, storytelling, roleplay, brainstorming, editing, worldbuilding, journals, blogs, novels, scripts, and other written works.

The Service uses artificial intelligence to generate text based on user prompts.

AI-generated responses are created automatically and may contain inaccuracies, errors, fictional information, or offensive content.

4. Guest Users and Premium Accounts

Rogue Pen may be used without creating an account.

Certain features require a Premium subscription and account registration.

When creating an account, you agree to provide accurate information and keep your account secure.

You are responsible for all activity occurring under your account.

5. Acceptable Use

You agree not to:

  • Violate any applicable law.
  • Use Rogue Pen to facilitate criminal activity.
  • Upload malware or harmful code.

You retain ownership of all content you create using Rogue Pen.

By using the Service, you grant Rogue Pen a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and otherwise use your content solely as necessary to:

  • Synchronize content across your devices
  • Maintain backups
  • Secure the platform
  • Improve the functionality and reliability of the Service

This license does not transfer ownership of your content.

We do not claim ownership of your work.

This license ends when your content has been permanently deleted from our systems, except where retention is required by law or exists within routine backup systems.

7. AI Training

Your content is used only to provide the Service.

Rogue Pen does not use your private content to train public AI models.

Rogue Pen does not sell your writing to third parties.

8. Responsibility for Your Content

You are solely responsible for everything you create, upload, or generate using Rogue Pen.

You represent that:

  • You own the rights to your content or have permission to use it.
  • Your content does not violate applicable laws.
  • Your content does not infringe copyrights, trademarks, or other intellectual property rights.
  • Your content does not violate another person's privacy or publicity rights.

9. AI-Generated Content

Artificial intelligence is inherently unpredictable.

Rogue Pen makes no guarantee that generated content will be:

  • Accurate
  • Complete
  • Reliable
  • Original
  • Error-free
  • Suitable for any purpose

You are responsible for reviewing, editing, and verifying all generated content before relying on or publishing it.

Rogue Pen does not provide legal, medical, financial, psychological, or other professional advice.

10. Intellectual Property

The Rogue Pen platform, software, branding, logos, design, interface, and underlying technology remain the exclusive property of Rogue Pen.

Except for your own content, no part of the Service may be copied, reverse engineered, redistributed, or exploited without written permission.

11. Copyright Complaints

If you believe material on Rogue Pen infringes your copyright, please contact us at:

Include sufficient information for us to investigate your claim.

We reserve the right to remove allegedly infringing material while investigating.

12. Premium Subscriptions

Premium subscriptions provide access to additional features.

Subscription pricing may change at any time for future billing periods.

Unless otherwise stated, subscriptions renew automatically until canceled.

13. Refund Policy

Payments are non-refundable, except where required by applicable law.

Canceling your subscription prevents future charges but does not automatically entitle you to a refund for previous payments.

14. Service Availability

Rogue Pen is provided on an "as available" basis.

We may:

  • Modify features
  • Remove features
  • Add new functionality
  • Perform maintenance
  • Suspend the Service
  • Discontinue the Service entirely

at any time without prior notice.

We do not guarantee uninterrupted availability.

15. Suspension and Termination

We may suspend or terminate your access at our sole discretion, including for:

  • Abuse of the Service
  • Violations of these Terms
  • Illegal activity
  • Fraud
  • Security concerns
  • Conduct that may harm Rogue Pen or other users

Termination may occur without prior notice.

16. Disclaimer of Warranties

To the fullest extent permitted by law, Rogue Pen is provided "AS IS" and "AS AVAILABLE."

We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability.

17. Limitation of Liability

To the maximum extent permitted by law, Rogue Pen shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.

Our total liability for any claim shall not exceed the amount you paid to Rogue Pen during the twelve (12) months preceding the claim.

If you have never paid Rogue Pen, our total liability shall not exceed one hundred U.S. dollars (US $100), to the extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Rogue Pen from any claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use of the Service
  • Your content
  • Your violation of these Terms
  • Your violation of applicable law
  • Your infringement of another person's rights

19. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration.

You waive any right to bring claims in court or participate in a class action, except where prohibited by law.

Arbitration shall be conducted under applicable arbitration rules and governed by the laws of the State of California.

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
